1. General Information
1.1 Developer Identification

This document may be updated to reflect changes in the developer's corporate structure. In the event that a legal entity is established to assume ownership of Seiru, these Terms will be updated with due notice to users.
1.2 Service Description
Seiru is a mobile application for emotional support and mental well-being that combines a specialized chatbot based on artificial intelligence, validated therapeutic techniques (cognitive-behavioral therapy, mindfulness, dialectical-behavioral therapy, among others), and a gamification system with pixel art RPG aesthetics. The Service is available for mobile devices with iOS and Android operating systems.
Seiru offers the following main functionalities:
- Conversation with an AI-based emotional companion ("Guardian") that remembers the user's history, emotions, and progress between sessions.
- Daily mood check-in with visual feedback in a personalized RPG world ("The Kingdom of Seiru").
- Guided therapeutic exercises: breathing techniques, grounding (5-4-3-2-1), journaling, and mindfulness.
- Progress and habit system: streaks, experience points (XP), and narrative achievements.
- Crisis mode with guided breathing, emotional validation, and country-localized emergency resources.
- Deep cultural localization with therapeutic frameworks adapted to each market (not merely language translation).
1.3 Acceptance of Terms
By downloading, installing, registering for, or using Seiru, you ("the User") agree to be bound by these Terms and Conditions of Use ("Terms") as well as by our Privacy Policy, which is an integral part of these Terms. If you do not agree with any provision of these Terms, you must not use the Service.
Continued use of the Service following the publication of modifications constitutes acceptance of the modified Terms. The User will be notified of any substantial changes through notice within the application and/or by email with at least fifteen (15) days' advance notice.
1.4 Available Languages
Seiru is available in seven (7) languages: Spanish, English, Japanese, German, French, Italian, and Portuguese. In case of discrepancy between language versions of these Terms, the Spanish version shall prevail as the original document.
2. Medical Disclaimer and Mental Health
IMPORTANT NOTICE: Seiru is NOT a medical, psychological, or therapeutic service. Seiru does NOT provide diagnoses, treatments, medical prescriptions, or clinical advice. Seiru's Guardian is NOT a therapist, psychologist, psychiatrist, or licensed mental health professional.
2.1 Nature of the Service
Seiru is a digital emotional companion that uses artificial intelligence to provide general emotional support, well-being techniques, and a space for reflection. The responses generated by the AI are informative and supportive in nature and in no case substitute for professional mental health care.
The User understands and accepts that:
- The Guardian's responses are generated by a large language model (LLM) and may contain inaccuracies, incomplete information, or responses inappropriate for the User's specific situation.
- The AI cannot fully understand the complexity of human situations, the complete emotional context, or the individual circumstances of each person.
- The therapeutic exercises offered are based on academically validated techniques, but their application through an application does not equate to supervised professional therapy.
- No result, progress, or perceived improvement through Seiru is guaranteed, as results vary significantly among individuals.
2.2 Situations for Which Seiru is NOT Appropriate
Seiru is not designed and should not be used as a primary tool for:
- Primary treatment of diagnosed mental health conditions (severe depression, bipolar disorder, schizophrenia, PTSD, among others).
- Management of active suicidal crises or self-harm. While Seiru includes a crisis mode with emergency resources, this does NOT substitute for immediate professional intervention.
- Management or prescription of medications.
- Eating disorders, substance abuse, or addictions.
- Situations of domestic violence or abuse requiring immediate intervention.
2.3 Crisis Protocol
Seiru incorporates a crisis detection system that uses AI to identify risk indicators in conversations. When a possible crisis situation is detected:
- Guided breathing and emotional validation are offered.
- Country-localized emergency resources are displayed (crisis lines, emergency services).
- The user is directed toward professional care.
However, this system has inherent limitations: the AI may not detect all risk signals, may misinterpret emotional or cultural context, and cannot guarantee an appropriate response in all circumstances. If you or someone you know is in immediate danger, contact local emergency services (your country's emergency number) immediately.
2.4 Recommendation for Professional Care
The developer strongly recommends that Seiru be used as a complement, never as a substitute, for professional mental health care. If you experience persistent symptoms of emotional distress, anxiety, depression, or other mental health concerns, consult a licensed mental health professional in your jurisdiction.
3. Use Requirements and Registration
3.1 Minimum Age
Use of Seiru is limited to persons who are at least thirteen (13) years of age. In jurisdictions where local legislation establishes a higher minimum age for consent to personal data processing (for example, sixteen [16] years of age in certain European Union countries under the GDPR), the minimum age established by such legislation shall apply.
For users between thirteen (13) and sixteen (16) years of age in jurisdictions requiring it, use of Seiru is conditioned on obtaining verifiable consent from a parent, mother, or legal guardian.
Seiru does not intentionally collect information from minors under thirteen (13) years of age. If the developer becomes aware that a minor under thirteen has provided personal information, such data will be deleted immediately.
3.2 Account Registration
To use Seiru, the User must create an account by providing:
- A username (not necessarily your real name).
- A valid email address.
- A secure password.
- Selection of language and country of residence (for cultural localization and crisis resources).
The User is responsible for maintaining the confidentiality of their access credentials and for all activities conducted from their account. The User must immediately notify esteban@seiru.app of any unauthorized use of their account.
3.3 Acceptable Use
The User commits to using Seiru responsibly and in compliance with the law. The following are prohibited:
- Using Seiru for any illegal or unauthorized purpose.
- Attempting to access accounts, data, or systems of other users.
- Performing reverse engineering, decompiling, or disassembling any part of the application.
- Deliberately introducing malicious content, viruses, or harmful code.
- Using the service to generate content that promotes violence, hatred, discrimination, or illegal activities.
- Impersonating the identity of another person or entity.
- Using bots, scrapers, or automated mechanisms to interact with the Service beyond normal application use.
- Sharing, redistributing, or commercializing Seiru's AI responses as if they were professional mental health advice.
4. Artificial Intelligence and Technical Limitations
4.1 Technology Used
Seiru uses large language models (LLMs) provided by OpenAI to generate conversational responses, detect crisis signals, and update the user's profile. Specifically:
- Conversation: GPT-4.1-mini model (or equivalent updated version) for interactions with the Guardian.
- Crisis detection: GPT-4.1-nano model (or equivalent updated version) as a risk signal classifier.
- Embeddings and RAG: text-embedding-3-small for semantic search in the therapeutic knowledge base.
Specific models may change over time to improve the service. Any changes that substantially affect functionality will be communicated to users.
4.2 AI Data Processing
When using Seiru, the User's conversations are processed by AI servers operated by OpenAI (third-party provider) to generate responses. This means that:
- The User's messages are sent to OpenAI servers for processing.
- OpenAI processes this data in accordance with its own API data usage policy, which as of the date of these Terms establishes that data sent through the API is not used to train models.
- Seiru stores the conversation history on its own servers (PostgreSQL on Google Cloud, asia-northeast1 region, Tokyo) to provide continuous memory functionality.

4.3 AI Limitations
The User acknowledges and accepts that:
- The AI may generate inaccurate, misleading, or inappropriate responses for the User's situation.
- The AI lacks clinical judgment, genuine empathy, and true understanding of human emotions.
- The Guardian's memory is based on AI-generated summaries of the user's profile, which may contain inaccuracies or lose important nuances.
- Crisis detection is based on language patterns and may fail to recognize subtle, culturally specific, or indirectly expressed signals.
- AI performance may vary depending on language, cultural context, and the complexity of the situation described.
- Interruptions from third-party services (OpenAI, Google Cloud) may affect Service availability or quality.
5. Subscriptions, Payments, and Advertising
5.1 Service Tiers
Seiru operates under a freemium model with three subscription tiers:
- Traveler (Free): 20 daily messages (mana), mood check-in, basic Kingdom features. Includes limited advertising with option to watch ads for additional mana (maximum 2 ads per day, +5 mana per ad).
- Adventurer ($6.99 USD/month or $49.99 USD/year): 200 daily messages, long-term memory enabled, personality tests (Big Five, attachment style), no advertising.
- Hero ($10.99 USD/month or $79.99 USD/year): 500 daily messages, all Adventurer features, early access to new functionalities.
Localized prices for Japan: Adventurer: ¥1,080/month or ¥7,500/year. Hero: ¥1,680/month or ¥11,800/year. These prices are approximate and may vary depending on exchange rates and app store.
Prices may vary depending on the app store (Apple App Store, Google Play Store) and the User's region. The prices shown do not include applicable taxes, which will be calculated by the corresponding app store.
5.2 Billing and Renewal
Subscriptions are managed and billed through the corresponding app store (Apple App Store or Google Play Store). The subscription automatically renews at the end of each billing period (monthly or yearly) unless the User cancels it.
The renewal charge will be made within 24 hours before the end of the current period. The User will receive a notification from the app store prior to each renewal.
5.3 Cancellation
The User may cancel their subscription at any time through:
- The subscription settings of the corresponding app store (Apple App Store or Google Play Store).
- The settings section within the Seiru application itself, which will redirect to the app store's cancellation flow.
Cancellation will be effective at the end of the current billing period. The User will retain access to paid features until the end of such period. After cancellation, the account will revert to the Traveler (free) level.
For users in the European Union: In accordance with the Consumer Rights Directive, you have the right to withdraw from your purchase within fourteen (14) days of initial subscription, unless you have begun using the paid service, in which case you accept waiving this withdrawal right.
5.4 Refunds
Refunds are governed by the policies of the corresponding app store (Apple or Google). The developer does not process payments directly and therefore cannot issue refunds autonomously. To request a refund, the User must contact the support of the respective app store.
5.5 Advertising
The Traveler (free) tier includes advertising provided through Google AdMob. This advertising:
- does NOT use data from conversations with the Guardian, mood status, or mental health information for ad targeting.
- is NOT displayed during crisis mode or during therapeutic exercises.
- is limited to non-intrusive and respectful formats for user experience.
- does NOT specifically target minors with personalized advertising.
Google AdMob may use device identifiers and general technical data for ad selection, in accordance with its own privacy policy.
5.6 Crisis Resources Always Free
Crisis resources (emergency button, guided breathing, localized emergency resources) are always available free of charge to all users, regardless of their subscription level. These functionalities will never be subject to payment nor use limitations.
6. Intellectual Property
6.1 Developer's Ownership
Seiru, including its source code, visual design, pixel art, characters (Guardians, Bestiary), Kingdom narrative, trademarks, logos, and all associated materials, are owned by or licensed to the developer. All rights are reserved.
Seiru's therapeutic knowledge base is built from open access academic sources, including publications from PubMed Central, PLOS ONE, WHO, and other sources with Creative Commons licenses, and is used in accordance with their respective licenses.
6.2 User Content
The User retains ownership of all content they generate or input into Seiru (messages, mood status notes, journal entries). By using the Service, the User grants the developer a limited, non-exclusive, non-transferable, and revocable license to process such content solely for the purpose of providing and improving the Service.
This license includes the AI processing necessary to generate responses, update the user's profile, and maintain continuous memory. This license terminates when the User deletes their account or specific content.
6.3 Anonymized and Aggregate Data
The developer may use completely anonymized and aggregated data (which does not permit identification of any individual user) for research, service improvement, and statistical analysis purposes. This data will never include conversation content or identifiable mental health data.
7. Limitation of Liability
7.1 Exclusion of Warranties
Seiru is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or continuous Service availability.
7.2 Limitation of Liability
To the maximum extent permitted by applicable law, the developer is not liable for:
- Direct, indirect, incidental, special, consequential, or punitive damages arising from use or inability to use the Service.
- Damages arising from AI responses that are inaccurate, inappropriate, or harmful.
- Failures in crisis detection or failure to identify risk signals.
- Emotional distress or psychological harm attributed to AI-generated content.
- Loss of data, including conversation history or progress data.
- Service interruptions caused by maintenance, technical failures, or causes beyond the developer's control.
In any case, the developer's total cumulative liability to the User for any claim related to the Service shall not exceed the amount actually paid by the User to the developer during the twelve (12) months preceding the claim, or one hundred US dollars (USD $100), whichever is greater.
Note: Some jurisdictions do not permit the exclusion or limitation of certain damages or warranties. In such jurisdictions, the above limitations will apply to the maximum extent permitted by law.
7.3 Indemnification
The User agrees to indemnify and hold the developer harmless from any claim, damage, loss, liability, and expense (including reasonable attorney fees) arising from or related to: (a) the User's use of the Service, (b) breach of these Terms, or (c) infringement of third-party rights.
8. Privacy and Data Protection
User privacy is a fundamental priority for Seiru. The complete handling of personal data is detailed in our Privacy Policy, a separate document that is an integral part of these Terms. Below are the fundamental principles:
- Data minimization: Seiru collects only the data necessary to provide the Service.
- No data sales: Seiru NEVER sells, rents, or shares mental health data, conversations, or mood status with advertisers, data brokers, or third parties for commercial purposes.
- Right to deletion: The User may request complete deletion of their account and all associated data at any time.
- Limited retention: Conversation history is retained for a maximum of twelve (12) months.
- Encryption: Data is transmitted via TLS 1.3 encryption and stored with encryption at rest.

9. Service Availability and Modifications
9.1 Availability
The developer will make reasonable efforts to maintain continuous Service availability, but does not guarantee that the Service will be available uninterrupted, error-free, or secure at all times. The Service may experience interruptions due to maintenance, updates, technical failures, or circumstances beyond the developer's control.
9.2 Service Modifications
The developer reserves the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without prior notice. In the event of Service discontinuation, the developer will make reasonable efforts to:
- Notify users at least thirty (30) days in advance.
- Allow users to download or export their data before closure.
- Provide proportional refunds of active subscriptions for the unused period.
9.3 Updates to Terms
The developer may update these Terms periodically. Updates will be notified through notice within the application and/or by email. For substantial changes, a minimum of fifteen (15) days will be provided for the User to review the new Terms before they take effect. Continued use of the Service after such period implies acceptance of the updated Terms.
10. Termination
10.1 By the User
The User may delete their account at any time from the application settings or by contacting esteban@seiru.app. Upon account deletion:
- The User's personal data will be deleted in accordance with the timeframes established in the Privacy Policy.
- Conversation history will be permanently deleted.
- Progress data (XP, streaks, achievements) will be deleted.
- Active subscriptions must be canceled separately through the app store.
10.2 By the Developer
The developer may suspend or terminate the User's account if:
- The User materially violates these Terms.
- The User uses the Service in a way that compromises system security, stability, or integrity.
- Required by court order or legal provision.
In the event of termination by the developer, the User will be notified and granted a reasonable period to download their data, unless termination is for security or legal compliance reasons that preclude such a period.
11. Applicable Law and Conflict Resolution
11.1 Applicable Law
These Terms shall be governed by and interpreted in accordance with the laws of Japan, without prejudice to the mandatory consumer protection provisions of the User's habitual residence jurisdiction that are more favorable.
In particular, users residing in the European Union, United Kingdom, Australia, and other jurisdictions with consumer protection legislation shall retain the rights granted to them by their local mandatory laws, and no provision of these Terms shall limit such rights.
11.2 Conflict Resolution
The parties shall attempt to resolve any controversy arising from these Terms in good faith through direct negotiation for a period of thirty (30) days. If the controversy is not resolved, it shall be submitted to arbitration in accordance with the International Chamber of Commerce (ICC) Rules, with the seat in Tokyo, Japan, and in English language.
For EU users: The European Commission offers an online dispute resolution platform available at https://ec.europa.eu/consumers/odr. EU consumers may also resort to the courts of their habitual place of residence.
12. General Provisions
12.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between the User and the developer regarding the use of Seiru and supersede any prior agreement or communication.
12.2 Severability
If any provision of these Terms is declared null, invalid, or unenforceable by a competent court, the remaining provisions shall remain in full force and effect.
12.3 Waiver
The developer's failure to exercise or delay in exercising any right or remedy under these Terms shall not constitute a waiver of such right or remedy.
12.4 Assignment
The User may not assign or transfer these Terms or their rights or obligations under them without the developer's prior written consent. The developer may assign these Terms to a successor in connection with a merger, acquisition, or sale of assets, with notice to the User.
12.5 Force Majeure
The developer shall not be liable for failure or delay in performance of its obligations when such failure or delay is due to causes beyond its reasonable control, including but not limited to natural disasters, pandemics, wars, riots, internet infrastructure failures, interruptions of third-party services (AI providers, cloud services), or governmental acts.
12.6 Communications
The developer may communicate with the User through: notices within the application, email to the address provided during registration, or push notifications (if the User has authorized them). For User communications to the developer, the primary channel is esteban@seiru.app.
13. Region-Specific Provisions
The following provisions apply additionally based on the User's jurisdiction of residence:
13.1 European Union and European Economic Area (GDPR)
- The legal basis for data processing is the User's explicit consent (Article 6.1.a and Article 9.2.a of the GDPR).
- The User has the right of access, rectification, erasure, restriction of processing, data portability, and objection.
- International data transfers are carried out in accordance with Standard Contractual Clauses approved by the European Commission or equivalent mechanisms.
- The User may lodge a complaint with the data protection authority of their country.
13.2 United Kingdom (UK GDPR and DPA 2018)
- Provisions equivalent to the GDPR adapted to United Kingdom legislation apply.
- The User may lodge a complaint with the Information Commissioner's Office (ICO).
13.3 Japan (APPI — Act on Protection of Personal Information)
- Personal data processing complies with the APPI (Act No. 57 of 2003, as amended in 2022).
- Data is preferentially stored in the asia-northeast1 (Tokyo) region of Google Cloud.
- International data transfers are carried out in accordance with Article 28 of the APPI.
13.4 United States
California (CCPA/CPRA): California residents have additional rights:
- Right to know what data is collected and how it is used.
- Right to deletion of personal data.
- Right to opt out of the "sale" or "sharing" of personal data. Seiru does NOT sell or share personal data as defined by CCPA/CPRA.
- Right to non-discrimination for exercising these rights.
COPPA: Seiru does not intentionally collect data from minors under 13 years of age. If a minor under 13 is identified, their data will be deleted immediately.
13.5 Mexico (LFPDPPP)
- Data processing is carried out in accordance with the Federal Law on Protection of Personal Data in the Possession of Private Parties.
- The User has ARCO rights: Access, Rectification, Cancellation, and Objection.
- The complete Privacy Notice is available in the Privacy Policy.
13.6 Chile (Law 21.719)
- Data processing is carried out in accordance with Law 21.719 on Protection of Personal Data.
- The User has ARCO rights as per Chilean legislation.
13.7 Argentina (Law 25.326)
- Data processing is carried out in accordance with Law 25.326 on Protection of Personal Data.
- The User has the right of access, rectification, erasure, and confidentiality.
13.8 Singapore (PDPA) and Philippines (Data Privacy Act 2012)
- Explicit consent is required for health data processing.
- Users have rights of access, correction, and withdrawal of consent.
13.9 Australia (Privacy Act)
- The Australian Privacy Principles (APPs) apply.
- Health data receives additional protection as sensitive information.
- The User may lodge a complaint with the Office of the Australian Information Commissioner (OAIC).
